TRP is a document issued by Immigration Canada that allows people who are inadmissible to Canada to visit the country. These are not to be confused with TRV. One may be a status document while the opposite may be a Travel Document. The Temporary Resident Permit, a travel document, will allow you to visit and enter Canada despite your inadmissibility.
A TRP allows an individual to overcome their inadmissibility for a specified reason. The applicant is required to demonstrate there is a major reason they need to enter Canada. A person who is criminally inadmissible to Canada is inadmissible for work, study, visitation purposes, and is prohibited from submitting an application for Canadian permanent residence.
Eligibility for a Temporary Resident Permit
TRPs allow officers to respond to exceptional circumstances while meeting Canada’s social, humanitarian, and economic commitments. The decision on whether or not to issue a TRP is at the full discretion officer and will take into the following factors:
Inadmissible and seeking to come into Canada if an officer is of the opinion that it is justified in the circumstances;
In Canada and is inadmissible, subject to a report or reportable for violation of the Act, or does not otherwise meet the requirements of the Act;
Not eligible for restoration of status.
Successful TRP applicants will usually be people who can prove that they are doing not pose a risk to Canada and that they will not burden Canada’s welfare system. Any evidence that can help prove these two qualities will increase a person’s chances of success.
Validity of a Temporary Resident Permit
A TRP may be valid for a period of between one day and three years. When deciding how long the validity period of a TRP will be, authorities will consider the following factors:
The length of the person’s visit to Canada.
Whether there is a compelling need for the TRP to be issued.
Whether there are risks involved in issuing the TRP and, if so, whether the compelling need outweighs these risks.
If the person is applying for a second TRP, whether any new admissibility issues have arisen since the issuing of the first TRP.
In cases where a TRP holder has also been issued a work permit or a study permit, the TRP will have a validity period equal to the validity period of the other permit.
Temporary Resident Permit Application Process
To apply for a TRP, you must submit your application with all the necessary documents and the non-refundable application fee. Your application must include the following:
apply in the paper to the appropriate visa office responsible for your country of nationality or residence,
clearly request for a TRP,
include all the reasons you believe make you eligible for a TRP,
include documents related to your inadmissibility,
police clearance certificates;
letters of reference including a letter from your employer; and
a personal statement from you.
If you lived in the United States during the past 10 years you must also submit an FBI police certificate.
